RENTAL CONFIRMATION AND AGREEMENT

This is a rental Agreement between “OWNER”, Jill and Charles Henry, DBA Mountain Valley Center, and “RENTER”, hereinafter referred to as “Responsible Party” or “RP”. “Guest(s)” refers to any and all persons and/or ‘pet(s) other than the “RP”.

Financial Arrangements
Rental Rate ( rates do not reflect additional state and local taxes (currently 10% ).

• Minimum 2 night stay at $ 150.00 per night, up to 6 people.

• Each Additional night at $ 75.00 per night, as long as cottage available.
• Standard Occupancy is 6 people
• Security Deposit: $100.00.

There is no credit given for late arrival or early departure.

Responsible Party” assumes full financial and personal responsibility for any and all ‘guests’ and all damages, even if damages exceed the Security Deposit.

Payment & Cancellation Policies

• Your Reservation is confirmed upon our receiving this signed Rental Agreement and confirmed payment of ½ total rental fee including taxes, by cash (in person), check, money order or credit card. This payment is not refundable.
• The remaining balance, taxes and security deposit are due and payable immediately prior to occupancy.
• If you cancel this reservation more than 14 days before scheduled arrival, your advance payment may be applied to a new reservation at the ‘then current’ Rental Rate, based on cottage availability and at owners’ discretion.
• If you cancel this reservation within 14 days of scheduled arrival, your advance payment will be forfeit.
• Payment may be made by check, money order or credit card or in person by cash. Mountain Valley Center, 10248 Georgia Road, Otto, NC 28763, Toll-free at 888-773-2491.
• The RP signing the Rental Agreement acknowledges that (s)he is over the age of 18 years old, and acknowledges accepting full responsibility for all financial obligations relating to this Rental Agreement, and accepts full personal responsibility for any and all ‘guests’ who may use the rental dwelling and/or grounds during the rental period.
  
  Responsible Party: I have read this contract and agree to abide by the specific conditions as mentioned here and on the following pages, as well as the implied conditions. By my signature, I agree to hold the “OWNERS” harmless from any and all responsibilities and/or liabilities that might result from the presence of myself and/or my guests and/or pets while on the premises, or making use of any facilities on the premises, or as a result of being on the premises. Any and/or all of my guests witness agreement to this ‘hold harmless’ clause by their presence on the premises.

  Responsibilities of “OWNER”

• to provide a 3 bedroom, 2 bath, residential dwelling, including kitchen facilities
• Bed linens are provided along with pillows and blankets, for 6 persons.
• Bath towels and washcloths are provided for 6 persons
• Basic kitchen utensils are provided, including pots, pans, plates, cups and forks/spoons/knives.
• Refrigerator and microwave are provided.
• Washer and Dryer are provided.
• There are NO foodstuffs provided, no salt, no pepper, no sugar, no bath soaps, no laundry detergent.
• To provide electrical, water and telephone service to the dwelling
• Telephone service (828-369-3017) is provided for toll-free and local calls & Non-Collect incoming calls.
• Satellite TV.
• These services are provided but are not guaranteed and may be interrupted due to extenuating circumstances.
• Hot Tub is available and may be used per additional written agreement and re-imbursement.
• Outdoor campfire may be allowed per additional written agreement and re-imbursement.
• Access to Labyrinth Park dawn to dusk is un-limited. This is a public-access park and exclusive use of the Park by “RP” and “guests” is not granted.
  
  Responsibilities of “Responsible Party”
• One person over the age of 18 must sign the RENTAL AGREEMENT and is considered to be the RESPONSIBLE PARTY for all financial and personal obligations under this contract.
• The Responsible Party is to ensure that all ‘guests’ abide by the specifics of this rental agreement. “RP” and all guests shall not make claim against OWNER for any and/or all loss or injury or damage to person(s), and/or pet(s) and/or property sustained while on the premises and/or as a result of being on the premises.
• Upon Departure,
• leave key(s) on kitchen table.
• Lock all doors
• Please leave the cottage and grounds in the condition that you found them.
• Place used linens and towels on top of washer
• Wash dirty dishes
• Bag trash and place in garbage can outside kitchen door
• Pets are welcome and stay for free. “Responsible Party” assumes full responsibility for any and all pets and all damages, even if damages exceed the Security Deposit.
• There is to be no smoking within the dwelling or meeting room. Smoking may be done on the front deck, the rear porch, about the grounds. Ashtrays are provided.
  
  Security Deposit is required at the time of occupancy by cash (in person), check, money order or credit card. This security account will be settled within 10 days of departure. Security Fees may be charged for:
• Any damage to the dwelling and/or the grounds, beyond ordinary wear.
• Not returning access key(s).
  
  Additional Services
  ◙ Hot Tub: $45.00 per stay, FREE FOR LIMITED TIME!!! filled with mountain water, maximum capacity of 5 people, no pets. “Responsible Party” held liable for water damage as a result of tub use and/or overflow.
  
  ◙ Fire Permit: $45.00 per stay, Purchased on-site.  REQUIRED FOR OUTDOOR FIRES, includes the following
• Labyrinth ( Evening Use) provides Torches and Fuel.
• Outdoor Fire Starter Kit, this includes enough wood and starter for one fire.
• If “OWNER” finds Torches and/or fire burning without written permit, Security Deposit is forfeit and Responsible Party” and all guests must vacate the premises immediately.
• Weather conditions here in the mountains may require that no burning permit be issued. This decision is at the sole discretion of the “OWNER”.
